Present: Councillors Roger Webber (Chairman), Linda Atkins, Eric Clarbull, Chris Harding and Frank O’Neill; Marlene Allinson (Parish Clerk), Co Cllr Frances Nicholson and W Somerset Cllr Steven Pugsley were present.
196.1  Public Question Time: No items raised.
196.2 Apologies of Absence: The Police.
196.3  Declarations of Interest:   Cllr Webber: 5.1 Lower House CLEUD: brother of the applicant, left the room; Cllr Clarbull 8.1 and 8.3 Chairman of the Moorland Hall Committee, personal, minuted.
196.4  Minutes: The minutes of the meeting held on 10th December 2013 were approved and signed by the Chairman as a true record. Matters Arising: 194.9 WCX toilets: a meeting is arranged 05/02/14 with WSC; ENPA will not attend; 195.8 Trees at the triangle: Philip Farmer to carry out the work shortly.
196.5  196.5.1 Planning Applications: 6/8/13/110 Raleigh Lodge: proposed variation of condition 2: fully supported, an improvement on the original. 6/8/13/111 Lower House: Certificate of Lawful Development re use of a building as a farm workshop: this should not have been sent in by ENPA as a planning application as it is a CLEUD. Statutory declarations as evidence can be submitted: no comments. 196.5.2 Other Planning Matters: the Clerk reported on planning approvals for Blagdon Cross (agricultural building) and Old Stowey Farm (storage building); neighbouring parishes: Smallcombe Farm: appeal won for a temporary 3-year building;
East Harwood Gallops: appeal to be heard next month.
196.6  Highways: Luckwell Bridge Road Closure: Cllr Nicholson been working with Highways to ensure goes as smoothly as possible; the Clerk showed the road signs and had circulated Highways’ response to questions asked of SCC; Highways not been in touch with landowners re trimming hedges while the road is closed: FN to follow up. Potholes: Codsend, reported; FN to check on meanings of various colours of markings; Putham Lane potholes still not repaired; FN will check on progress of the work on Cutcombe Hill; Cllr Webber reported on blocked gullies by Church Cottages and between the School Gate and the Phone Box. Cllrs Webber and Pugsley have an Agenda item for this week’s Exmoor Panel meeting: preventative road maintenance. The Clerk to try to find out who owns the ash tree on the corner at LB by the phone box. 
196.7  W Somerset College Admissions Consultation: details had been circulated to Cllrs before the meeting: to bring back comments for a Parish Council response to the February meeting.
196.8  Finance: It was agreed to pay: 196.8.1 Retrospectively £626.40 to Countrywide Grounds Maintenance for grass cutting (reimbursed by the Moorland Hall); 196.8.2 50% of the annual subscription to SLCC (£50.50); 196.8.3 £10 to the Moorland Hall for room hire.
196.9 Correspondence and Meetings: 196.9.1 The Clerk reported on the SV meeting earlier that evening and that the next Exmoor Consultative and Parish Forum will be at Withypool on Thursday 30/01/14 at 10.00 am and had circulated details of SALC training courses.
196.9.2 Cllr Pugsley reported that Penny James, new Chief Executive of WS Council, will visit Wheddon Cross 23/01/14 at 3pm. Co Cllr Nicholson reported on the Dulverton School public consultation. SCC is holding a public meeting 7-9pm at Dulverton Town Hall on 11th February.
195.11 Items for the next Agenda: West Somerset College Admissions Consultation; repayment of £104.40 to the Moorland Hall (overpaid for grass cutting); retrospective payments to: Media Edge invoice for SV postcards (£150); Media Edge for SV tickets (£72); Nic Wigley for SV expenses (£54.29); cash floats for SV totaling £70.00.

197.4  Minutes: The minutes of the meeting held on the 21st January 2014 were approved and signed by the Chairman as a true record. Matters Arising: 196.6 Ash tree at Luckwell Bridge: the Clerk has not ascertained ownership.
197.5  197.5.1 Planning Applications: None. 197.5.2 Other Planning Matters: 6/8/13/110 Raleigh Lodge: variations to planning application 6/8/11/105: approved. 106 Agreements for Local Needs Housing: these have now been varied by ENPA to help with mortgage lending.
197.6  Highways: Potholes at Putham/Popery Lane: still not repaired. Co Cllr Nicholson will follow up, Highways inundated with flood problems at the moment.  Road Closures reported:  Dunster 10/03/14 for 12 days; Combeshead Cross to Stolford Hill Cross and White Post to Combeshead Cross, Brompton Regis: 31/03/14 for 1 day. Flooding: areas where water is a problem please feed in to Cllr Webber and he will take up with Highways.
197.7  100 Years of the Start of the Second World War: it was agreed to put this as an Agenda item at the next Annual Parish Meeting of Electors in May.
197.8  W Somerset College Admissions Consultation: the Clerk was asked to write in reply expressing concerns about the future of Cutcombe School and copy to the relevant officers at ENPA, SCC and WSC.
197.9  Exmoor Nationak Park Authority Public Call for Potential Housing Sites: details had been circulated before the meeting. Any site can be nominated. ENPA will set up a panel to decide if land is acceptable as a potential housing site.
197.10 The Parish Lengthsman Scheme 2014/15: As agreed when setting the 2014/15 Precept Cutcombe’s days are to be reduced to 7 days.
197.11 Finance: It was agreed to pay: 197.11.1 £104.40 to the Moorland Hall (overpayment re grass cutting, retrospectively); 197.11.2 £25 to SALC for training; 197.11.3 SV co-ordinator’s expenses £56.38 (retrospectively) 197.11.4 £150 to Media Edge for SV postcards and £72 for SV tickets; 197.11.5 £54.29 for SV co-ordinator’s expenses; 197.11.6 Cash floats for SV (retrospectively).

197.12 Correspondence and Meetings: 197.12.1 The Clerk reported on a SV meeting prior to this one. 197.12.2 Cllr Webber reported that Revd Weir to speak at the APME in May and that he went to the Exmoor Panel Meeting. Toilets: a meeting had taken place to discuss their future with WSC, Cllrs Webber and Atkins and the Clerk. Cllr Davis reported on a letter from the Exmoor Youth Club: the Clerk to circulate to all Councillors. Co Cllr Nicholson reported that the meetings re the future of Dulverton School had been well attended.

198.1  Public Question Time: The applicant for planning application 6/15/14/102 Triscombe Farm outlined the need for the function room. Nic Wigley gave a summary of Snowdrop Valley Park and Ride Scheme 2014 and was thanked for her work. Police Report: read out by the Parish Clerk: an e-mail scam re parking tickets, no reported crimes.

198.4  Minutes: The minutes of the meeting held on the 18th February 2014 were approved and signed by the Chairman as a true record. Matters Arising: 197.12.1 Toilets: Cllr Webber had been in touch with ENPA re renewables for the toilets: no useful response. WS Cllr Puglsey stressed the need to meet with Exford PC asap: Cllrs Webber and Pugsley to arrange.

198.6  Highways: Co Cllr Nicholson reported that the WX Crossroads work is in hand. She will progress Popery Lane potholes and report the poor state of Thorne Lane. The Clerk reported that the wall by the phone box at Luckwell Bridge has been damaged by the road contractor: she is progressing. The road sweeper has not been seen for ages in Cutcombe: the Clerk and WS Cllr Pugsley to progress. Parish Lengthsman: The Clerk read out a letter from Dulverton Town Council re Cutcombe’s reduced days for 2014/15. The Lengthsman Agreement was signed by the Chairman.

198.7  Finance: It was agreed to pay: 198.7.1 £307.72 for the 2014/15 Parish Lengthsman Scheme 198.7.2 SV workers’ net wages (£2391.72) 198.7.3 Parish Clerk’s Salary and Expenses (£653.15) 198.7.4 Inland Revenue Tax and NI due (£526.40) 198.7.5 It was agreed to appoint Derek Bott as internal auditor for 2013/14 198.7.6 £10 to Moorland Hall for room hire agreed 198.7.7 Ex-gratia payments of £50 to Exmoor Farmers and £100 to Badgworthy Land Company were agreed. The Clerk to liaise with Cynthia Stevens re work on the website and report back. 198.7.8 SV co-ordinator’s expenses £22.39 were agreed 198.7.9 Parish Clerk’s SV expenses £247.41 agreed 198.7.10 Atwest buses’ invoice for SV Park and Ride 2014 (£3,795): agreed. The Clerk reported that new legislation has been passed re the use of internet banking for Parish Councils (the “dual signature” rule): to be looked into by the Finance Working Party.
198.8 Correspondence and Meetings: 198.8.1 Annual Parish Meeting of Electors will take place on Wednesday 7th May: Revd David Weir will speak, others to be invited. The next Exmoor Consultative and Parish Forum will take place at Withypool on 27/03/14 at 7pm. 198.8.2 Cllr Webber reported on a meeting with Rupert Harrison (Magna) re tree felling opposite the School: two trees to be left as is, Magna will replant at the right time of year: have funding for the trees but not the planting. Will be in touch again when replanting time is here.
A meeting with the police Commissioner, ENPA and others will take place at WX next Tuesday 25/03/2013. Cllr Davis reported on the Exmoor Panel meeting and thanked Cllrs Pugsley and Nicholson for their support for the Exford Youth Club.

199.1  Public Question Time: The applicant for planning application 6/8/14/102 spoke and left the meeting at 7.45. Police Report: read out by the Parish Clerk: no reported crimes, some traffic incidents in relation to the recent car rally.

199.4  Minutes: The minutes of the meeting held on the 18th March 2014 were approved and signed by the Chairman as a true record. Matters Arising: 198.4 197.12.1 Toilets: WS Cllr Pugsley has spoken with Dave Hancock, a retired architect who has project managed several toilet revamps: he is checking to see if he has time for Cutcombe. It was agreed that he be asked to come up with ideas if he can as he is experienced and charges very reasonable fees.
199.5  199.5.1 6/8/14/102 Shearwell Data: proposed replacement agricultural building, associated yard area and landscaping. Proposed resubmission of part of approved application 6/8/12/105 (1591m2); Fully supported. 199.5.2 No other planning matters.
199.6  Highways: Co Cllr Nicholson reported that the WX Crossroads work is progressing. The road sweeper has been and done a good job. WS Cllr Pugsley has spoken with Chris Hall at WSC who is in charge of road sweeping and is requesting a schedule of visits. Road slips at Cutcombe Hill: no progress report but they should have been inspected by now. Pothole at Combeshead on the Dunkery Road is falling in again: the Clerk to report also to progress with the police the car down the bank off Cutcombe Hill.
199.7  Finance: 199.7.1 Retrospective invoice for Active Signs (SV £79.20) approved. 199.7.2 Annual review of the Clerk’s contract: deferred until the next meeting  199.7.3 Annual membership of the Community Council for Somerset (£35) approved 199.7.4 SALC annual membership for 2014/15 (£103.46) approved 199.7.5 Invoice from the Moorland Hall for £10 for room hire approved. The Clerk reported that the accounts are ready for audit and the statutory notice re inspection is now on the main noticeboard.
199.8 Correspondence and Meetings: 199.8.1 Cllr Webber and the Clerk had attended a meeting with Commissioner Sue Mountstevens and the police. It was agreed that Steve Shaw, National Co-ordinator for Local Works should be supported in his proposal “that the government take the necessary action to allow a percentage of Business Rates to be paid direct to Parish and Town Councils for the benefit of local economic growth”. 199.8.2 Co Cllr Nicholson reported that the results of the Dulverton School consultation should be made public during the first week of term and hopefully any decisions made by the end of the summer term for implementation next school year.
199.9 Items for the next Agenda: Review of the Clerk’s contract.

The next meeting of Cutcombe Parish Council will be the Annual Parish Council meeting at which the Chairman for the coming year is elected. This will be held on Tuesday 13th May 2014 at 7.30pm in The Moorland Hall (one week earlier than usual, the second Tuesday in the month).


All are warmly invited as they are to the Annual Parish Meeting of Electors which will take place on Wednesday 7th May at 7 for 7.30pm in the Moorland Hall.

200.2 Election of Chairman: Cllr Roger Webber was unanimously re-elected as Chairman and signed the Declaration of Acceptance of Office.

200.6  Minutes: The minutes of the meeting held on the 15th April 2014 were approved and signed by the Chairman as a true record. Matters Arising: none.
200.7  200.7.1 Planning Applications: none. 200.7.2 The Clerk reported that Shute Close planning application 6/8/14/101 had been approved.
200.8  Highways: Putham Lane and Popery potholes: all are still not repaired. A letter of complaint from Shearwell was reported and e-mails from Co Cllr Nicholson who is progressing. It was agreed that the Clerk contact Shearwell with a view to putting more pressure on Highways. Cutcombe Hill: boreholes have been taken and the Structures Team is to meet with their external consultant re arresting the road slip. Tabbitts Steep: gullies which had been left too low are to be raised at the expense of the contractor.
200.9 The Moorland Hall and Recreation Ground: a meeting is to be arranged in June/July for the Parish Council working party (Cllrs Webber and Atkins and the Clerk) and the Moorland Hall working party (Eric Clarbull, Kevin Snewing and Jim Matravers) to get together and draw up an agreement with regard to the management of the Recreation Ground with a view to this replacing the existing lease. Eric Clarbull to contact the Clerk with possible dates.

201.4  Minutes: The minutes of the meeting held on the 13th May 2014 were approved and signed by the Chairman as a true record. Matters Arising: 200.9 The Moorland Hall Committee has not yet got back to the Clerk to arrange a meeting. 200.10 The Clerk to find out the cost of a larger dog litter bin than those already in place and seek permissions for the erection of a bin in the car park near the toilets. Cllrs Webber and Atkins met with Dave Hancock re redesigning the toilets: another meeting is arranged for 27th June. 200.12 The co-option process is in place, notice on the noticeboard re deadline for an election.

201.6  Highways: Crossroads: Co Cllr Nicholson reported that this is still ongoing. The Clerk was asked to write expressing frustration at the slow nature of this coming to fruition. Putham Lane and Popery potholes: to be brought up at the Exmoor Panel Meeting this Thursday at the Moorland Hall, 7pm: Cllrs Webber and Davis will attend.
201.7 Appointment of Portfolio Holders: due to the resignation of Chris Harding it was agreed that Cllr Frank O’Neill be asked to replace him: this item adjourned to the next Agenda due to the absence of Cllr O’Neill.
201.8 Finance: 201.8.1 A payment of £20 to the Moorland Hall for room hire in April (retrospective) and a payment of £25.50 for May were approved. 200.8.2 Three applications had been received: it was agreed to give £100 to C.L.O.W.N.S. the other two requests to be brought back to the December meeting. 201.8.3 It was agreed to pay the Clerk’s quarterly salary and

Cllr Webber had attended a meeting of the Exmoor Consultative and Parish Forum at which the forthcoming elections for Parish Members to ENPA had been discussed. Cllr Atkins had attended a meeting of the Patient Group at which the possibility of setting up a virtual patient group had been mentioned.
Co Cllr Nicholson gave an update re Dulverton School. WS Cllr Pugsley informed everyone that WS Council will be deciding tomorrow re committing finance to increasing broadband provision and that ENPA is seeking to establish better communications with WS Council.

202.5  Co-option of a Parish Councillor: Vivian White was the only applicant and was duly unanimously elected to serve on Cutcombe Parish Council and welcomed to the meeting.

202.7  202.7.1 Planning Applications: none for consideration.
202.7.2 The Clerk reported that Planning Applications 6/8/14/103LB (Oaktrow) and 6/8/14/104 (Raleigh Lodge) have been approved. Area between Cutcombe and Wheddon Cross excludes the area allocated for the extension of Cutcombe First School but encompasses the rest of the field behind the school: objection received from the owner re designation as an area of important visual amenity space: the Parish Council sees no reason for this designation as the area should be protected by the usual planning rules. Quarme Combe: the Clerk to check on the landscaping conditions and bring to the next meeting as an Agenda item.
202.8  Highways: Crossroads: Co Cllr Nicholson agreed to talk to David Wyborn, ENPA, re finalizing the 106 Agreement as the money needs to be handed to SCC Highways before works can commence as per the scheme agreed a year ago. A meeting will then take place with all parties concerned to get the works underway. The Clerk to ask SCC for a costing on the crossroads work as all of the money set aside is to be set in the Parish. Car parking in the village and at The Rest & Be Thankful Inn: copies of a letter from the landlord were circulated. It was resolved by a unanimous vote that “this Parish Council is not prepared to alter the boundaries of the recreation ground in accordance with the original conveyance of the land but is willing to work with the Rest & Be Thankful Inn and all other interested parties to try to alleviate parking problems in and around the village.” Gratings at Luckwell Bridge: Cllr Webber reported that these have been raised. Putham Lane: Co Cllr Nicholson reported that this is RUPP not a road but she is of a view that it should be upgraded to a road and is in discussions with SCC as it not only serves Shearwell but local residents and visitors.
202.9 Resolutions: “Cutcombe Parish Council resolves to adopt the Fete Committee and the Parish Party Committee as sub-committees of the Parish Council with limited, specified powers and written terms and conditions to be drawn up and agreed by all parties” (this so that these two events may be encompassed by the Parish Council’s insurance policy [at no additional cost]).
 202.10 Update on an additional dog litter bin: it was agreed that the Clerk order an additional 25 litre red dog litter bin (current cost £84), subject to the emptying cost by WSC being no more than £2.50 per week and the requisite siting permissions obtained. Cllr Clarbull to liaise re a suitable site in the car park.
202.11 Finance: 202.11.1 It was agreed to pay an invoice from Countrywide Grounds Maintenance in the sum of £1,039.66. 202.11.2 The Clerk reported that the 2013/14 audit has now been satisfactorily concluded, statutory notice is on the noticeboard.
202.12 Correspondence and Meetings: 202.12.1 Correspondence: EDF Plugged in Newsletter June 2014. Meetings: the Clerk reported on a meeting re the lease between the Moorland Hall and the Parish Council. 202.12.2 Correspondence: Cllr Webber reported on a letter from Across Exmoor saying that they are short of production funds: to be an Agenda item for August. Meetings: Cllr Clarbull reported that he had been in touch with the Moorland Hall’s insurers and the bulk of their premium is for cover for the hall not the Recreation Ground.

Matters Arising: 202.5 Cllr White signed the Members’ Acceptance of Declaration of Office book. 202.8 Cllr Webber has spoken to the landlord of the Rest & Be Thankful Inn re arranging a meeting to discuss parking issues.

203.6  Highways: Crossroads: ENPA and SCC have been contacted: the 106 Agreement is being drawn up for signature. Cutcombe Hill: Co Cllr Nicholson to check the timetable for the proposed works: the Clerk to liaise with her and write to Highways re safety concerns. Signs: it was agreed that the Parish Lengthsman be asked to clear around the signs on his visit tomorrow. Parking: the Clerk read out the Police report which included details of enforcement of parking near a junction. The Clerk asked to follow up a reported theft of a mobile phone at the Londis shop.  Putham Lane: Co Cllr Nicholson to collate all correspondence and report back asap. Light in the car park: WS Council’s meter has been read and it is understood that they are to reimburse the landlord for electricity costs. Popery Lane: has been patched and tarred and chipped. Parking in the road near the garage: more signs have been put up asking customers to park in the car park which is being under-utilised. Co Cllr Nicholson agreed to include Cutcombe in the current round of applications for 20mph speed limits.
203.7 Update on an additional dog litter bin: an additional agreement for the extra bin with WS Council was signed by the Chairman subject to the 10% admin cost on cost of emptying contract being removed. The Clerk to order the bin as agreed at last meeting: the revised emptying costs were agreed: £3.50 per week rising to £3.70 on 01/10/15.
203.8 Finance: 203.8.1 It was agreed to pay an invoice from the Moorland Hall for room hire (£10). 203.8.2 It was agreed to pay Grant Thornton £120 for the external audit. 203.8.3 It was agreed to issue a cheque under #137 of £100 to Cutcombe PCC as a contribution towards the printing costs of Across Exmoor.

204.5  204.5.1 Planning Applications: 6/8/14/106 21 Meadow Close: proposed erection of a log cabin in the garden for use as a summerhouse and hobby centre for personal use: No objection in principal but whilst the cabin is obscured from the applicants and no windows on the nearest house, it can be seen from other properties in Meadow Close: their views should be taken into consideration including the colour of the wood.

206.1  Public Question Time: Cllr Clarbull (as Chairman of the Snowdrop Valley Steering Group) introduced Gemma Wesley as the new SV Assistant Co-ordinator, after which Gemma left the meeting. Items raised: concerns over the Dunster road closure and its effect on businesses and the Snowdrop Valley Park and Ride Scheme and the roadworks for the new Washford Cross roundabout; concern over retrospective planning applications; speeding at Luckwell Bridge. Police Report: update on the badger cull and associated problems; reports of thefts from outbuildings. WPCSO Hurley said that an upgrade of the cameras at Wheddon Cross does not meet the criteria: to let us know what the criteria are.

Concern expressed at the effect of public confidence in the planning system due to the number of retrospective planning applications. 206.5.2 Planning applications granted: 6/8/14/106 21 Meadow Close, log cabin; 6/8/11/108 land adjacent to the Moorland Hall, local affordable dwelling.
206.6  Highways: Wheddon Cross Crossroads: site meeting with Highways arranged for Friday 19/12/2014 at 9am. Verge Cutting: Co Cllr Nicholson reported that Highways are hoping to have a map of all parishes showing what will (and will not) be cut asap and that she is seeking funding for fingerpost renovation.  Speeding at Luckwell Bridge: the Clerk to write to Gary Warren to arrange a site visit if possible; the Police to investigate if a speed recording device could be put in place. Putham Lane: still in abeyance. Cutcombe Hill: it is hoped that the small works team will repair the top part before Christmas, rest will be next year as the ground is a less stable condition. 20mph speed limit for Cutcombe: Co Cllr Nicholson reported that the application has not been successful. The Parish Salt Bag allocation needs to be collected this
coming Saturday from the Highways depot in Minehead: Cllr Clarbull agreed to ask Cllr Davis if he can collect the bags. The Clerk has the Winter Service 2014/15 Leaflet showing the salting routes.
206.7 Grass Cutting Contract: it was agreed that a tender document be prepared for 2015/16 and sent out and that a two year contract should be aimed for with a clause giving an option to extend for a further year.
206.8 Finance: 206.8.1 Parish Precept 2015/16: deferred until next meeting for further discussion 206.8.2 Parish Lengthsman: It was agreed to keep the same number of days for 2015/16 (7 = £307.72). The Clerk to find out dates and times for the Key Committee meetings.
206.8.3 It was agreed to pay £30 to the Moorland Hall for room hire. 
206.9 Correspondence and Meetings: 206.9.1 Correspondence: as circulated prior to the meeting and details of Magna Stakeholders’ Conference (18/11/14) and EDF Bulletin.
206.9.2 Correspondence: WS Cllr Pugsley reported that a letter has been sent out to all parishes informing them that the Grant to Parishes (precept grants) would not be given in 2015/2016. Meetings: Cllr Clarbull reported on a Snowdrop Valley meeting; Cllrs Webber and White reported on the last Exmoor Panel meeting and Cllr White on the Exmoor Consultative Forum: the next meeting is 20/11/14 at Withypool at 10.30am. WS Cllr Pugsley reported on a meeting with Karen Mills, the Parish Clerk and Cllrs Webber and Atkins relating to the Wheddon Cross toilets. It was agreed to write to Karen Mills expressing an interest in looking into the possibility of the toilets being refurbished by WS Council and leased to the Parish Council, which would only be considered after suitable public consultation and full costings have been explored.

    207.1  Public Question Time: Concerns were expressed re retrospective planning applications and the nature of the items on the agenda. It was unanimously resolved to put a resolution on the next Parish Council meeting agenda regarding retrospective planning applications.

    207.4 Planning Applications at Steart Farm: 6/8/14/108 retention of a workshop/agricultural building (185m2) retrospective and 6/8/14/109 retention of a biomass building (40.5m2) retrospective: comments apply to both as the two buildings are joined: In principle, as a result of a majority vote, the Parish Council does not object to there being a building of this size in this location for the purposes intended. However the appearance of the building could be improved, for example by the use of more cladding and less concrete/cement being visible. A minority supported retention of these buildings without conditions. 6/8/14/110 proposed erection of an agricultural building/storage (432m2): The building is not objected to in principle for the purposes as outlined in the planning application. However, the proximity to the river is a concern although it is understood that the Environment Agency has no objections. Council would, therefore, like to see conditions imposed that ensure that the proposed uses of the building are adhered to (“Agriculture/forestory/storage use. The agricultural use will be for machinery. Timber storage for production of timber pellets as a renewable energy source for the biomass boiler. General storage is for materials used in the servicing and provision of drainage systems”), this being to ensure that no cattle or livestock are stored in the building at any time.

Exmoor National Park Authority Notes re Meeting with the Parish Council 9th December 2014
David Wyborn explained that it is a Government decision that retrospective planning applications for change of use or for a building erected without planning permission is not an offence. However, risks are taken: enforcement, demolitions, costs, not appearing on searches when trying to sell a property, etc. Around 170 investigations of such breaches are made by ENPA per annum. ENPA seeks retrospective applications to regularise the situation and this gives everyone (eg local residents, the Parish Council) a change to comment and ENPA collects the relevant fees. If no planning application is forthcoming an enforcement notice is served. If this then goes to appeal the applicant has to pay double the planning fee. It is felt that no additional fee is payable for a retrospective application as this would discourage them coming forward.  Most applications to which a Parish Council objects will go to the ENPA Planning Committee and if the Parish Council has a different opinion to that of the relevant Planning Officer. ENPA employs an enforcement officer and a part-time monitoring officer.
David Wyborn offered to talk to new Councillors who come on to the Parish Council after the election in May.

Present: Councillors Roger Webber (Chairman), Linda Atkins, Eric Clarbull, Tim Gardner, John Davis, Vivian White, Marlene Allinson (Parish Clerk), SomersetCo Cllr Frances Nicholson (left at 8.50pm), West Somerset Cllr Steven Pugsley (left at 9.15pm), David Wyborn and Joe White (Exmoor National Park Authority) and one parishioner for Public Question Time.
208.1  Public Question Time: David Wyborn circulated ENPA’s Pocket Guide 2014/15, a Planning Update for Parish Councils (Sept 2014) and a Guide to Planning Enforcement in ENPA and answered questions regarding planning in ENPA, in particular with regard to retrospective planning applications. These leaflets and a copy of notes of this part of the meeting are available on application to the Clerk. The notes are also on the Wheddon Cross website.
208.2 Apologies of Absence: Cllr Frank O'Neill, the Police (report sent in).
208.3  Declarations of Interest: Cllr Clarbull, personal, Chairman of the Moorland Hall, invoice for the Moorland Hall (retrospective item for January 2015 meeting).
208.4 Minutes and Matters Arising: the minutes of the meetings held on 18th and 27th November (with one amendment) were approved as a true record and signed by the Chairman. 206.9.2 Cllr Pugsley reported that the lease on the car park is 999 years from 1971 from The Rest & Be Thankful Innto WSC; a response from Karen Mills should be with the PC in the New Year.
208.5 208.5.1 Planning Applications: Oaktrow Farm 6/8/14/111 proposed siting of shepherd’s hut for holiday letting and 6/8/14/112 proposed agricultural building (127.65m2, resiting of existing building): no objections to either. 208.5.2 Other Planning Matters: 6/8/14/107 2 Meadow Close: application for rear glazed canopy approved. A resolution was debated and unanimously approved that: “Cutcombe Parish Council considers that ENPA needs to publicise more widely the perils and consequences of not going through proper planning procedures.” The Clerk to write to David Wyborn and Joe White with a copy of this resolution for their comments and to thank them for attending the meeting tonight.
208.6 2015/16 Parish Precept: it was agreed to increase the precept by 8% this representing an increase for a Band D property of £3.66 a year. The Parish Council was disappointed to note that WS Council will not be paying grants to Parish Councils for 2015/16 in respect of the Council Tax rebate Scheme, although this is not applicable to Cutcombe.
208.7 Highways: Putham Lane: ongoing; Cutcombe Hill: repairs to the top landslip should be done before the Dunster Road Closure.
208.8 208.8.1 Section 137 grant requests: received from Somerset Wildlife Trust, NSPCC and AtWest: it was agreed to grant £50 to AtWest 208.8.2 The Clerk’s quarterly salary and expenses were agreed (£620.82) 208.8.3 Tax and NI due agreed to be paid 208.8.4 It was agreed not to pay for the Exmoor Flag from precepted funds 208.8.5 The Clerk’s Snowdrop Valley expenses paid from the SV account (£142.40)

208.9 Correspondence and Meetings: 208.9.1 The Clerk reported on a Snowdrop Valley meeting and read out a report from the Police. 208.9.2 Cllr Davis had attended a meeting of the Standards Committee which stressed that new Cllrs should attend Code of Conduct training; Cllr White had been to the Exmoor Consultative and Parish Forum meeting. Cllr Webber reported that Enid Mantin had now resigned as a West Charity Trustee and it was proposed that she be replaced by Angela Edwards: all present were in favour. Cllr Gardner reported that he would like to form a Vision for Cutcombe Group within the next two to three months with one or more representatives from the Parish Council.
208.10 Items for the next Agenda: retrospective agreement for an invoice for £20 for the Moorland Hall for room hire; Reinforcement of the Code of Conduct re Parish Councillors.
